Course Description
The problem of “shadow justice” (or parallel justice) has become apparent to varying degrees in Germany and it has moved into the focus of the public debate, especially in the context of clan-organized crime. However, this structure of conflict resolution can be encountered in many areas of life, for instance in a large number of family law cases. It has its origin in thousands of years old customary law and it is influenced by religious values like the Sharia law. We see a structure of an internal conflict resolution, which operates in secret, ignores the state’s legal system, and expresses another standard of values and a different system of norms. Individual rights are restricted, the state's decision-making monopoly is disregarded, the fundamental values of our constitution are ignored and the execution of criminal or other legal proceedings are aggravated.
